The Ruling on Talaq in Writing
Question
Question: A man is writing a divorce deed to his wife while saying nothing with his tongue. Will this talaq take effect or not?
Answer
It will take effect: [ar]كتب الطلاق إن مستبينا على نحو لوح وقع إن نوى مطلقا[/ar] “If he wrote the talaq, then, if the writing is legible (mustabin) — for example on a tablet — it takes effect if he intended it; unconditionally” (al-Durr al-Mukhtar).
