The talaq of a minor

Question

Kindly send a Shari‘a fatwa on the following question and be rewarded by Allah: may the guardian (wali) of a minor give talaq to the minor’s wife on the minor’s behalf, and will such a divorce deed be regarded as valid on behalf of the actual husband?

Answer

According to the Shari‘a a minor can neither give talaq to his wife himself, nor can his guardian (wali) give talaq to his wife on his behalf; in such a case the divorce deed is invalid: [ar]الْخَامِسُ كَالطَّلَاقِ وَنَحْوِهِ فَلَا يَمْلِكُهُ: أَيْ لَا يَمْلِكُ الصَّبِيُّ بِنَفْسِهِ الْخَامِسَ وَلَوْ بِإِذْنِ وَلِيِّهِ، حَتَّى لَوْ طَلَّقَ الصَّبِيُّ امْرَأَتَهُ بِإِذْنِ…
