Relating Talaq to the Woman: “Earlier I Gave Two Talaqs, Now I Gave One”
Question
Zayd started a quarrel and a row with his mother. Meanwhile his mother said: “Because of this your wife treats me with disregard.” Then Zayd said: “I will leave her” (اس کو چھوڑوں گا), and confirmed it with an oath (تاکید تحلف کی) and went away. Having gone into the house and prepared a bundle and so on with the intention of running away, he came out onto the veranda and said: “آگے دو طلاق دیا تھا، اب ایک دیا” (“Earlier I gave two talaqs; now I gave one”).
Answer
If Zayd has one wife, to whom he had already given two talaqs before, then in the case asked about three talaqs have without any doubt taken effect, and the divorce has become major (mughallaza): [ar]ولو قال لها: «داد مت يك طلاق» وسكت، ثم قال: «ودو طلاق وسه طلاق»، تقع الثلاث. ولو قال: «ترا يك طلاق» وسكت، ثم قال: «ودو»، يقع الثلاث. ولو قال: «دو»
