A fish enclosure on a riverbank and others catching fish from it (calling a scholar a thief or reviling him)

Question

Question: For about 25 years Zayd has held some land obtained from the government under the land settlement, situated on a riverbank. To protect it from the flooding of the river water, the government built a high embankment on the river edge of this land. With the government’s permission Zayd made a channel in this embankment opposite his own land so that the inner water could drain away as needed, that is, so that the water of the eastern land of Zayd, Amr and Bakr would drain away and the crops would not be…

Answer

(a) For this reason alone it is not incumbent on Zayd to shut off the water of this channel. (b) No; rather, it will be permissible (mubah), because it is originally permissible (لأنه مباح الأصل). (c) It will be impermissible: [ar]ولا يجوز بيع سمك لم يُصَد، أو صِيد وأُلقي في حظيرة لا يؤخذ منها بلا حيلة، أو دخل إليها بنفسه ولم يسدّ مدخله، فإنه لا يجوز.
