A form of interest
Question
Question: A butcher took a few rupees from Zayd for the meat trade and made the condition: “When I slaughter my cow on the second or third day, I will give you one seer (a unit of weight, ≈ 0.93 kg) of meat, and then after a month and a half or two I will repay all the money.” Is it permissible to eat this meat which the butcher is giving in addition to the money? Can this form fall under mudaraba (a partnership in which one party provides the capital and the other the work)?
Answer
This is interest, and therefore impermissible: [ar]كل قرض جر نفعًا حرام[/ar] “Every loan that draws a benefit is haram” (al-Durr al-Mukhtar). [ar]قال الشامي: أي إذا كان مشروطًا. اهـ[/ar] Shami ﵀ said: “That is, if it was stipulated” (Shami, vol. 2, p. 242). The way to be absolved of it is that he pays the price of that meat or deducts it from that money.
