Divorce Does Not Cancel the Mahr
Question
Mu‘in divorced his wife Rashida because she had left his house without a burqa (veil). After that, Rashida was married to another man. Must Mu‘in give Rashida her mahr or not, given that she left without permission?
Answer
The mahr has not lapsed because of this disobedience: Rashida’s mahr remains an obligatory (wajib) debt on Mu‘in. As for Rashida’s second nikah, if it was concluded after the expiry of the divorce ‘idda — three menstrual periods — it is valid.
