Excessiveness in mahr (mughala)
Question
(1) In the journal “al-Nur”, vol. 1/53 AH, p. 25, recorded saying no. 294, there is the following passage: “In reply it was said that the meaning of the prohibition of excessiveness in mahr (mughala) found in the hadiths is that a single person, against his community, should fix a small mahr; otherwise the jurists would have understood this secret. See: the jurists have written that if someone other than the father or grandfather marries a girl off for less than mahr al-mithl (the customary dower)
Answer
(1) Regarding mahr, the Shari‘a has specified that it must be at least ten dirhams; less than that is not permissible. Anything above that is the right of the woman and the guardians (awliya’). If a woman marries for less than mahr al-mithl without the consent of the guardians, the guardians have the right of annulment (faskh) through the qadi.
