Marrying Off One’s Child Without One’s Own Father’s Permission
Question
No one marries off his daughter or son to anyone without taking the parents’ permission. But if the young man’s parents never agree, because the elder brothers are still sitting unmarried, may he do it himself or not?
Answer
The better way, of course, is that when there are elders over one, one should contract the nikah of one’s daughter and son only in consultation with them. However, the guardianship of nikah (wilaya) belongs to the father of a minor. If benefit (maslaha) requires it, anyone may contract the nikah of his son and daughter even without asking his own father.
