Is a nikah not valid if it is not entered in the register?
Question
The nikah of one Ghulam Haydar, when he was 13–14 years old, to one Maryam, daughter of Sattar Shaykh, when she was 10–11 years old, was performed with the parents’ permission. Because the spouses were minors, the nikah was not entered in the register. Four to five years have passed since this nikah.
Answer
If Sattar Shaykh married his minor daughter Maryam to Ghulam Haydar in the presence of witnesses, then by the Sacred Law this nikah was concluded and became binding (lazim). Now, upon her reaching maturity, it is necessary (lazim) to send the girl to her husband’s house and to fulfil her husband’s demand for the bride’s send-off.
