Burying the deceased in another person’s land

Question

A deceased person was buried without permission on someone else’s land. Please inform us, according to the Shari‘a, whether this was permissible or not.

Answer

Burying a deceased in someone’s land without the owner’s permission is not permissible; it is a sin. The owner has the right to say to those who buried him: “Take your deceased out of here and bury him somewhere else, otherwise we will plough here, level the grave and cultivate the land.”
