Issuing a Wrong Fatwa and Rejecting a Fatwa
Question
If, according to the Sacred Law, Hinda is entitled to a share of Zayd’s property and wealth, as well as to her dower (mahr), and someone then denies or rejects this, or issues a fatwa against it for the sake of his own base desire, what offence does the Sacred Law impose upon such a person, and is prayer behind such a person permissible? Please give the answer with a reference [to the sources].
Answer
To reject a Sacred-Law fatwa without proof, and not to accept it, is a grave sin. If someone, disdaining this Sacred-Law fatwa, insults and belittles it, that is kufr, since it necessarily entails belittling the Sacred Law itself. Deliberately issuing a fatwa contrary to the Sacred Law out of base desire, thereby depriving one who has a right, is a great wrong and a major sin.
