If the government makes another person the tenant, it is valid
Question
Question: In our city the following law is in force: if some tenant, before such-and-such a year and date, has made someone else a sub-tenant of the shop he rents, and collects rent from the sub-tenant that is not due, and this sub-tenant brings his case before the court, then the court, after proof is furnished, orders the owner of the premises to make this sub-tenant the principal tenant. The question is: may a Muslim take advantage of this law of the government?
Answer
If the government terminates one person’s lease and gives the right of tenancy to another person, then making that person the tenant is correct.
