Intercourse with an animal

Question

Question: Zayd committed fornication (zina) with an animal, and in the noble hadith it has come: [ar]من أتى البهيمة فاقتلوه واقتلوا البهيمة[/ar] “Whoever has intercourse with an animal, kill him and kill the animal.” Now what needs to be ascertained is: may benefit and the like be derived from the animal with which intercourse was committed, or not? And how is Zayd to be dealt with according to the noble Shari‘a?

Answer

[ar]ولا يُحَدُّ بوطء بهيمة، بل يُعَزَّرُ، وتُذبح ثم تُحرق، ويُكره الانتفاع بها حيةً وميتةً. مجتبى. وفي النهر: الظاهر أنه يُطالَب ندبًا؛ لقولهم: تُضمن بالقيمة. اهـ (الدر المختار ٣/٢٣٨).[/ar] “No hadd is applied for intercourse with an animal; rather, ta'zir (discretionary punishment)
