If death results from a beating given as discipline
Question
Question: A man, after the death of his wife, married the widowed sister of his late wife. The widowed sister had a girl from her first husband. One day, over some matter, this man beat this girl; suddenly, a few hours later, the girl died. In reality this man had no intention of killing her. What is the ruling for such a man?
Answer
The one from whose beating this girl died is obliged to pay compensation (daman is wajib upon him): [ar]كَضَرْبِ الْمُعَلِّمِ إِجْمَاعًا، وَإِنِ الضَّرْبُ بِإِذْنِهِمَا لَا ضَمَانَ عَلَى الْمُعَلِّمِ إِجْمَاعًا.
