The Condition for the Shar‘i Punishment for Zina

Question

Question: Bakr committed zina (fornication) with his daughter-in-law. In this wretched era of British rule, what ta‘zir (discretionary punishment) should be imposed on him?

Answer

The right to carry out the Shar‘i hudud belongs to the Amir al-Mu’minin (Commander of the Believers). In the case asked about, both should be made to repent and a relationship of this kind should be cut off; and if they do not desist, then friendly relations with them should be severed. If a father commits zina with his son’s wife, she becomes haram for the son.
