Taking back bangles after giving them to a daughter
Question
Question: A woman, during her illness, while without consciousness and senses (?), gives her gold bangles to her daughter, in the presence of her husband and her elder son; no one has any objection to this act of the woman. The woman dies in that same illness. The woman’s gold buttons are kept with the father.
Answer
The mother gave the gold bangles to her daughter while ill, and then the mother died of that illness; so this has the status of a bequest (wasiyya). Its ruling is that if all the heirs are adults and consent to it, the daughter has become the owner of those bangles, and inheritance does not apply to those bangles.
