Exchanging an entrusted banknote for another
Question
Question: Bakr leaves with Zayd, as a trust (amana), a ten-rupee note of the year ’40. When Bakr asks Zayd for his trust, Zayd, instead of the ’40 note that had been given in trust, returns a ten-rupee note of ’47. Is Zayd guilty of breach of trust (khiyana) or not?
Answer
It is not permissible to alter or dispose of a trust that has been left with someone, because this is contrary to the safekeeping of the trust. Thus it is in the widely used books, such as Mirʾat al-Majalla and others.
