Spending the Income of a Graveyard on a Madrasa and an Eidgah
Question
(1) May the money of a graveyard be put into a madrasa or not? And if it may, then into which tasks? In particular, may it be used for the madrasa building or for the salaries of the teachers or not? (2) May an Eidgah (prayer ground for the Eid prayer) be built from the income of a graveyard? Also, on what expenditure may the income of a graveyard be spent?
Answer
(1, 2) It is not permissible to spend the income of an endowed (waqf) graveyard on any other purpose (a madrasa or an Eidgah): [ar]لأن شرط الواقف كنص الشارع[/ar] “…because the stipulation of the waqif is like the text of the Lawgiver” (thus in Radd al-Muhtar).
