Spending the Income of a Graveyard Orchard on the Mosque
Question
We have a graveyard, and inside it there is an orchard. It has long been devoted to a good cause and is used for roofing work. It belonged to two men: one of them gave up his share, and the other took the price of the orchard, which the villagers paid. Now the villagers have had this orchard cut down and planted another, new orchard; its trees have grown big, and some old trees also remain. The wood left over from the roofing work — that firewood has already been used in the mosque for heating water.
Answer
In such a situation it is permissible according to the Shariʿa to spend that firewood and the income of this orchard — whether fruit, grass or the like — on the mosque, as before.
