Building an Eidgah in a Graveyard

Question

There is a graveyard here; the graveyard is in active use, and the graveyard land is very large. We want an Eidgah (the ground for the Eid prayer) to be built on one part of it. The part set aside for the Eidgah is where the traces of these graves are very few. Is it permissible to build an Eidgah in this graveyard?

Answer

On land that has been made a waqf for a graveyard, building an Eidgah is not permitted, especially when it is in active use and the dead are buried there. Therefore the Eidgah should be built elsewhere.
