Talaq in exchange for rupees
Question
Question: A woman said to her husband: “If you give me talaq, I will give you three hundred rupees.” The husband agreed. In this case will talaq take effect or not? And if it has, what is the way to remedy it?
Answer
What did the husband agree to — did he only promise, or did he actually give the talaq? If he only promised talaq, then no talaq has occurred from that. But if he gave the talaq, and gave it in exchange for three hundred rupees, then an irrevocable (ba’in) talaq has taken effect; the right of taking back (ruju‘) no longer remains.
