The wife’s refusal to hand over the khul‘ compensation
Question
Question: Zayd’s wife said to Zayd: “I give you one bigha (a measure of land area) of land; in exchange for it, grant me khul‘.” So Zayd granted khul‘ on the said condition. Now, after the khul‘, Zayd’s wife is not ready to register the said land. So did the khul‘ remain valid or not? Can Zayd keep his wife or not? And has Zayd’s wife left his marriage or not? What is the ruling of the Shari‘a in this matter?
Answer
At the moment the wife said, “I give you one bigha of land; in exchange for it, grant me khul‘,” and Zayd accepted it, the khul‘ took place then and there and an irrevocable (ba’in) talaq took effect. Now there is no room left for the wife to refuse giving the land and having it registered; that wife has already left Zayd’s nikah.
