Conditional talaq, together with the Deoband fatwa

Question

Question: The following request for a fatwa (istifta) was sent to Deoband and to Saharanpur, and the two answers differ. The question together with both answers — both bearing seals — is being sent; kindly state in writing, with references, whether your answer is correct or the other one. This time a copy of the written undertaking is also being sent. Istifta: What do the scholars of the Shari‘a rule in the following matter?

Answer

Answer (1) — from Saharanpur Since the sum was not given within the stated period, talaq has taken effect in accordance with the condition. Merely going with the sum and looking for the members of the community council does not fulfil the undertaking.
