Three Talaqs in Anger

Question

Zayd gave his wife Zaynab, who was in his nikah and with whom the marriage had been consummated, one talaq. After that Zaynab’s father came to Zayd and began asking: “Have you given talaq?” Zayd said in anger: “ہاں میں نے تین مرتبہ طلاق دیدیا” (“Yes, I have given talaq three times”). However, Zayd says: “I gave only the first, single talaq; and what I said afterwards — ‘ہاں میں نے تین طلاق دے دیا’ (‘Yes, I have given three talaqs’) — I said only in anger; there was no intention of talaq in my heart.

Answer

In such a case three talaqs have taken effect judicially (qada’an). Therefore, if Zaynab herself heard this, or Zaynab’s father told Zaynab: “Your husband admitted to me talaq three times,” then it is not permissible for Zaynab to give her husband power over herself in any way before halala; rather, she must adopt every possible measure to avoid this.
