Giving unlawful wealth as a trousseau
Question
A certain man who was a doctor at one time bought some property after retiring from service, including some land for cultivation and an orchard; some of his personal money is deposited in the bank, and with the rest of the money he takes interest (riba) from ordinary people. A man has married his daughter, and this man is now righteous, abstinent and God-fearing; for him, in his wife’s trousseau, some such things have been given as anyone can use.
Answer
If no other Shar‘i impediment exists, then in the case asked about it is permissible to keep this girl in nikah. As for the property, there is a detailed ruling: if it becomes known that the doctor acquired this property by a lawful means — employment and the like — and gave it to the girl, then it is permissible for the husband to use it with the girl’s permission.
