Mahr Money for the Wife’s Medical Treatment
Question
Question: The mahr of Na‘im al-Haqq’s wife is two thousand rupees. The wife has TB (tuberculosis). Will the money of Na‘im al-Haqq that was spent on the wife’s treatment be counted towards the mahr or not?
Answer
If the husband said to the wife, “I will treat you with the money of your mahr”, and she gave permission, then in the case asked about no mahr remains owed by the husband. Otherwise, all the money he spent was a voluntary gift (tabarru‘) and a kindness, which will not now be counted towards the mahr.
