The wife forgave the mahr: the son has no right to claim it
Question
Hind, during her lifetime, forgave her mahr in favour of her husband Zayd; forty (40) years have passed since then. Now Hind’s son Bakr, who is at present 57 years old, is claiming his mother’s mahr. Can this claim of Bakr’s be valid?
Answer
If Hind forgave the mahr during her lifetime and while in health (before her final illness, marad al-mawt), then it lapsed from the husband’s liability. Now the son Bakr has no right to make a claim against his father.
