Nikah Through a Qadiani Agent

Question

A certain man is of Ahl al-Sunna wa-l-Jama‘a; he also contracted his daughter’s nikah within Ahl al-Sunna wa-l-Jama‘a. However, he made a Qadiani the agent (wakil) for his daughter’s nikah. What we wish to know is: is this Qadiani’s agency for the nikah (wakala bi-l-nikah) valid or not? In the second case, is the nikah valid or not?

Answer

If the girl was a minor and her father is present at the contract session (majlis al-‘aqd), and in his presence the Qadiani conducted the offer and acceptance (ijab and qabul), then the father himself will be regarded as the contracting party (‘aqid), the Qadiani’s agency is of no effect, and the nikah is valid.
