A Nikah Contracted Contrary to the Sarda Act
Question
What is the status in the Shari‘a of nikahs with regard to the law known as the Sarda Act (the law restraining child marriage)?
Answer
Nikahs which guardians (awliya’) have contracted contrary to the Sarda Act but in conformity with the Shari‘a are permissible and take effect. If such a nikah was contracted by the father or the grandfather, it is binding (lazim), and no option of any kind remains in it.
