Land of a non-Muslim held in hereditary tenancy
Question
Question: A reliable, religious man stated — and probably also cited Fatawa Rashidiyya — that there is a fatwa of Hazrat Qutb-e ‘Alam Hazrat Shah Rashid Ahmad Gangohi ﵀ that a Hindu’s land held in hereditary tenancy is permissible, while if it is a Muslim’s land it is altogether impermissible. Is the attribution of this statement to Hazrat ﵀ correct or not?
Answer
Ask him to specify the reference and find out the full whereabouts. What we have learned so far is only that Hazrat Gangohi ﵀ forbade it absolutely, whether (the land) is a Muslim’s or a Hindu’s. In Fatawa Rashidiyya, part two, Kitab al-Buyu‘, on p. 78, he forbade taking interest even from unbelievers.
