The Nikah of an Apostate Is Annulled
Question
Question: A Muslim young man has gone and joined the Qadiani sect. This young man’s first marriage was to a Muslim girl, and now he has made a second marriage with a Qadiani girl. The young man mostly stays away from home; whenever he comes home he tells the family: “I have become a Qadiani; now you cannot eat food from my hand, and you cannot even pray the funeral prayer (janaza) over me.” In this situation, has his first nikah been annulled or not?
Answer
Mirza Ghulam Ahmad Qadiani is a kafir according to the Shar‘i ruling, and whoever adopts his religion is also an apostate (murtadd), as a result of which his nikah has been annulled (faskh).
