Passing the Miqat Without Ihram
Question
A person sets out from India with the intention of performing Hajj. Is it permissible for him to pass the miqat without ihram or not, if he wishes to go first to Madinah the Blessed? Or a person sets out from here intending Makkah, and his intention is to stay in Jeddah for some days and do business, and after that to present himself in Makkah the Honoured — what is the ruling for him regarding passing the miqat without ihram? What is the miqat of the people of India?
Answer
For an afaqi (one who lives outside the miqats) who intends Makkah or the Haram, it is not permissible to pass the miqat without ihram — whether his intention is Hajj or ‘Umra, or sightseeing, trade and the like. If he does pass it, it is binding (lazim) upon him to come to some miqat and enter ihram; otherwise a dam (expiatory sacrifice) will become wajib upon him.
