The ruling when another’s right gets mixed into sherbet

Question

Question: If something halal and something haram — haram on account of an external factor — become completely mixed with each other, what is the ruling on the remainder after that quantity has been taken out? If it is halal, is it with or without dislike (karaha)? For example, with two glasses of sherbet, one glass of sherbet that was stolen or usurped (ghasb) got mixed; what is the ruling on the remaining two glasses of sherbet after one glass of sherbet has been taken out?

Answer

If another’s right becomes mixed with one’s own right, then a quantity corresponding to the other’s right should be separated from it and given to the owner; then the rest is halal. This issue is found in al-Durr al-Mukhtar and Fatawa ‘Alamgiri.
