Selling a house for a term of ten years
Question
Question: Owing to the need for household expenses, I sold my residential property, worth two thousand rupees, to a person for nine hundred rupees on the condition that if I pay the above-mentioned nine hundred rupees within ten years, the said buyer will return the sale and execute a sale deed in my favour.
Answer
In terms of the Shariʿa this sale did not become valid; rather, it has the ruling of a pledge (rahn), and it is not permissible for the buyer — who is in reality the pledgee (murtahin) — to benefit from this property during the said term. Whatever income there is belongs to the original owner, i.e. the seller, who is in reality the pledgor (rahin)
