Requesting the return of property within a fixed period after a definitive sale
Question
Zayd makes a definitive sale (bayʿ qatʿi) of his property in favour of Bakr, and he asks Bakr to grant him this concession: if, within a period fixed between the parties, Zayd pays back the money, Bakr will return the property to Zayd. Is this sale permissible according to the Shariʿa or not?
Answer
If neither in the deed of sale nor in the session of the contract was any return mentioned, whether as a condition or as a promise, but Zayd and Bakr bought and sold just as other people buy and sell day and night, and then in another session, at another time, Zayd asked Bakr for this concession and Bakr accepted it, then according to the Shariʿa this sale has become valid.
