A Form of Murabaha Sale
Question
A man said to another person, “We will sell your goods at one hundred rupees per quintal,” and then he sold those goods at 125 rupees per quintal; to the one who had spoken of selling the goods for one hundred rupees he gave 100 rupees, and kept 25 rupees for himself. Is it permissible to do this or not?
Answer
One should not transact in this way. Let him say: “Give me one hundred rupees,” and then the other, having bought, sells at whatever price he wishes; or let the owner of the goods say: “Sell these goods for as much as you like, and give me one hundred rupees”; or let him say: “I will sell these goods of yours for 125 rupees; give 25 rupees to me.”
