Selling Opium and the Like
Question
What is the ruling on trading in cannabis, cannabis drinks and opium?
Answer
Trading in cannabis, cannabis drinks and opium is makruh tahrimi; but if someone has done it, it will be valid. [ar]وصح بيع غير الخمر، أي عنده، خلافًا لهما في البيع والضمان، لكن الفتوى على قوله في البيع، وعلى قولهما في الضمان إن قصد المتلف الحسبة، وذلك يعرف بالقرائن، وإلا فعلى قوله، كما في التاتارخانية وغيرها. ثم إن البيع وإن صح لكنه يكره، كما في الغاية.
