Is the land of India ‘ushri or kharaji?

Answer

In the present situation, since the lands are the property of the state, they are neither ‘ushri nor kharaji: [ar]هذا نوع ثالث، يعني: لا عشرية ولا خراجية من الأراضي، تسمى أرض المملكة وأراضي الحوز[/ar] “This is a third type, i.e. lands that are neither ‘ushri nor kharaji; they are called ‘state land’ and ‘hawz lands’ (crown lands)” (“Shami”).
