A Dispute over Whether a Mosque Belongs to Sunnis or Shias
Question
A mosque was built about a hundred and fifty years ago by individuals of various communities, among whom were also the honourable Sayyids of Ahl al-Sunna wa-l-Jama‘a. As for the land, the stronger indication is that it belonged to those very Sayyids, who by madhhab were Ahl al-Sunna wa-l-Jama‘a. From the time the mosque came into existence until the writing of this istifta’ (request for a fatwa)
Answer
In the case asked about, in view of the circumstances described, that mosque is the mosque of Ahl al-Sunna wa-l-Jama‘a. Once land has been made waqf for a mosque, if on some occasion of construction even a non-Muslim contributes a donation, that does not give him the right to claim ownership.
