A father cannot annul the nikah of a minor
Question
Question: Zayd, with his own permission, married his minor daughter to a minor boy. Because of some enmity that arose, Zayd said: “I have annulled my daughter’s nikah.” Does Zayd have the right to annul the nikah, and is a nikah annulled by such words?
Answer
Zayd has no such right at all; this nikah cannot be annulled by his annulling it. The boy, on reaching puberty, will himself be entitled to give talaq.
