Which spouse’s witnesses are accepted regarding talaq
Question
Question: Zaynab says: “Khalid, my husband, gave me talaq.” Khalid denies it. Three or four persons confirm what Zaynab says. According to the Shari‘a, whose word will be believed?
Answer
If these witnesses of Zaynab are upright (‘adl) and reliable, Zaynab will be believed; and if they are not reliable and upright, or their testimony in Zaynab’s favour is not admissible, the husband’s word will be accepted with his oath.
