“If the wife goes to her parents’ home — three talaqs”
Question
Zayd was constantly quarrelling with his in-laws. Once Zayd’s wife went to her parents’ home, and her mother and father troubled Zayd a great deal and kept making excuses and putting off sending her back. Then, being compelled, Zayd said: «اگر میرے حکم کے بغیر میری بیوی میکہ چلی جائے تو میری بیوی کو تین طلاق ہو جائے گی» (“If my wife goes to her parents’ home without my permission, my wife will be given three talaqs”).
Answer
If the wife walked to her parents’ home on her own feet, and she was not lifted up and carried inside by force, then a major (mughallaza) divorce has fallen upon her. She should pass her ‘idda of three menstrual cycles (hayd)
