Making talaq conditional on the wife leaving in displeasure
Question
A man said to his lawfully wedded wife, with whom the marriage had been consummated (madkhul biha), as follows: “جو عورت میرے سے روٹھ کر میرے گھر سے گئی تو وہ بیوی میرے پر طلاق ہے” (“The woman who, displeased with me, goes out of my house — that wife is divorced from me”). After some time had passed, the wife was displeased at heart but stayed silent, and the husband said to her: “Go to your sons, who were in another house, and see how they are.” In this particular case does a revocable (raj‘i) talaq fall or not?
Answer
If the wife admits that the first condition was fulfilled, and the husband admits that the second condition was fulfilled, then in the case asked about two revocable (raj‘i) talaqs have taken effect — provided that the second condition was fulfilled within the ‘idda.
