Pronouncing Talaq After a Pledge Not to Divorce
Question
Zayd, while married, made this pledge to his wife Hinda: “If I deceive you in any way, may remoteness from God and His truthful Messenger ﷺ be my lot.” After this pledge Zayd learned from strong indications, and became fully certain, that Hinda had fallen into base vices. Having learned this, Zayd admonished her a great deal and showed much patience and forbearance.
Answer
If this incident is true, then in this case Zayd cannot be called a deceiver according to the Shari‘a, and it is not wajib upon Zayd to marry this woman again even after halala: he has the choice to do so or not.
