Details of the right of pre-emption (shufʿa)
Question
Question: What are the conditions for claiming the Sharʿi right of pre-emption (shufʿa) and for establishing it; what are the things on account of which this right lapses; what is the time limit for claiming it; and to which people does it belong?
Answer
When someone sells an immovable thing he owns — a house or the like — three categories of people, in order, acquire the right of pre-emption (shufʿa) over it: first, the one who is a co-owner in the sold property itself; then the one who is a partner in a right attached to the sold property — the passage; then the one who is a neighbour.
