What a father and son earned through joint labour is the father’s property

Question

Question: A man has two sons. The elder son is in gainful employment, while the younger son looks after the property (estate); at times the elder son too has put in work. Now the two of them are separating. How will the property be divided?

Answer

The father’s property on which these two brothers have worked will not become their property; rather, it belongs to their father alone. They have no right to divide it on their own: [ar]الأب وابنه يكتسبان في صنعة واحدة ولم يكن لهما شيء فالكسب كله للأب إن كان الابن في عياله لكونه معينًا له، ألا ترى لو غرس شجرة تكون للأب. انتهى كلام الشامي.
