Forgetting the First Sitting, Standing Up, Then Sitting Down

Question

If someone forgets the first sitting and stands up, and then, as soon as he remembers, sits down — what is the ruling regarding the invalidity of his prayer? Kindly explain with references to books and pages.

Answer

On this issue the jurists hold two views. According to one, his prayer has become fasid, and al-Zayla'i declared this view correct; according to the other, his prayer has not become fasid, although by this act he has become sinful and sajda al-sahw has become necessary for him; this view was preferred by Shaykh Ibn al-Humam, Ibn Nujaym, Halabi and others.
