A Girl’s Nikah Without Her Permission
Question
Zayd contracted the nikah of his adult daughter to Bakr in the girl’s absence, when she was a hundred miles away from the village. When the girl learned of it, she said on the spot: “I am here — how did my nikah take place there?” Did the nikah take place or not? If, when the girl reaches home, her father takes her permission expressing consent, will the nikah be valid or not?
Answer
If, on hearing the news of the nikah, she said on the spot out of excess of joy, “I am here — how did my nikah take place there?”, that is, she expressed joy at it, then that nikah became binding (lazim). Now there is neither a need to renew the nikah nor permission to marry elsewhere: the first nikah is sufficient and correct.
