A Second Nikah While the Husband Is Alive; Sale and Waqf of a House Not One’s Own

Question

The clarification having been made, I now respectfully submit, respected Mawlana, that our mosque (Shishgaran quarter, Firozabad) has five office-bearers. 3 persons are members of the committee; in all, among the members there are a president, a secretary, a treasurer and, besides them, 28 members; but the matter among them has become entangled. A woman named Hamidan, a resident of Aligarh district, has a living husband.

Answer

Since Nanhe knew that this woman was the wife of another man and that her husband had not divorced her — rather, she had been brought by deception — his nikah with her was not permissible; that nikah was never contracted at all. For as long as she lived with Nanhe, sin and fornication (haram) went on.
