A Mufti's Right to Limit His Fatwas by the Terms of His Appointment
Question
The income of a certain waqf is designated exclusively for a specific institution. May the income of the waqf, besides that, be spent on some other purpose? If a mutawalli (trustee) spends it contrary to the intent of the waqf, what is the Shari‘ah ruling on this?
Answer
The mufti is precisely the head teacher of the Madrasa ‘Aliya Congregational Mosque; therefore, kindly obtain a fatwa on this matter from some other Dar al-Ifta. The Waqf Board has prohibited answering matters of disagreement, and so [I am] excused [from answering]. That is all. ‘Abd al-Quddus Rumi.
